GENERAL CONDITIONS (PURCHASE AND SALE) 


As a user of our site and our services, it is essential that you have read and understood these terms and conditions before making a purchase. If you do not understand a particular element of this document, or if you disagree with one or more elements, please contact a member of our sales team before confirming your order. You can contact our customer service by e-mail (aftersales@thebeautifulwatch.com) The confirmation of your order marks your agreement and your obligation to respect these general conditions. We advise you to print a copy of these terms and conditions for any future orders.

Contract Terms: the terms and conditions contained herein. 

MC Watches, we, our: MC WATCHES, a limited liability company with a capital of 15,000 euros, registered with the RCI in the directory of Commerce and Industry in the Principality of Monaco under number 13S05983, whose registered office is at 7 avenue Princesse Grace – 98000 Monaco. Working days: any day of the week other than Saturday, Sunday or any public holiday defined as such in France and Monaco


OUR CONTRACTUAL RELATIONSHIP WITH YOU

 An age restriction applies to our Products. By placing an Order for the Products, you represent that you are 18 years of age. 

You can check and correct if necessary any error that may appear before confirming your Order. 

Please check each step in your Order process before confirming it. 

When you submit your Order, your Order represents an offer by you to purchase our Products. This does not mean that your Order has been accepted. . 

We will send you the acceptance of your Order by e-mail (titled Order Confirmation). The contractual relationship between us and you only begins upon receipt of the Order confirmation. Any Product forming part of the same Order but not having


not been confirmed in our Order confirmation is excluded from the contract binding us. The Products appearing on our Website are presented subject to availability. If we are unable to supply the Products to you (for example, if the Product is no longer available from our stock), we will notify you by telephone or e-mail and your Order will be cancelled. In the event that you have already paid for your Order, we will send you a refund equivalent to 100% of the amount of your Order within 5 working days of the cancellation of the Order (unless we have sufficient reason to believe that it is an Order placed and paid for by fraudulent use of a bank card.

I​​n some cases, Products shown on our Website are not available for dispatch until fully serviced (for example, the Product may be with a manufacturer and awaiting service or a particular part at the time you placed your Order). We will let you know if such a situation applies to one or more of the Products present in your Order before confirming it. We undertake to do everything necessary to complete the Service within a reasonable time, as well as to respect any announced deadline. However, to the extent that our business relies on third-party companies, it may be difficult for us to announce specific timeframes for the completion of the Service, and this Service may, in exceptional circumstances, take up to 2 months after acceptance of your Order. You can cancel the delivery of the products at any time before confirmation of delivery.

The images of the Products on our Website are for illustrative purposes only. Although we have taken care to present the Products and the colors as accurately as possible, we cannot guarantee a true-to-life representation on your screen, either in its resolution or in its color management.


PRICE AND PAYMENT

 Please take into account that the prices stated in these general conditions are expressed in Euros (€) and are therefore subject to exchange rate variations at the time of the transaction. This does not affect your consumer rights.

The price of the Products is set out in your Order. Our prices may vary at any time, but cannot be modified for Orders confirmed by us.

The prices advertised on our Website are in Euros (€). Payments must be made to us in Euros (€), refunds are also made in this same currency. We are not responsible for exchange rate variations which could affect the final amount of a refund if you are established outside of France.

Advertised prices include VAT (or any other equivalent sales tax) at the applicable rate. If the rate of VAT were to change between the date of your Order and the date of delivery, we will adjust the rate of VAT that you must pay, except in the case where you have already paid the full amount of your Order before the change in the VAT rate.

The advertised prices do not include delivery costs. The delivery costs will be communicated to you in accordance and will be added to the total amount due on the Order summary visible on our Website before confirming your Order.

You are required to pay when you confirm your Order, unless otherwise agreed. In any case, no delivery will be made until we have received the full payment due. Unless otherwise stated, we accept the following payment methods:

Debit card and credit card: card payments must be protected by 3D Secure technology;

Bank transfer: we accept bank transfers. We will provide you with our bank details before accepting your Order.


If we accept partial payment for your Order and we do not receive the amount still to be paid in full within 14 days of your partial payment, we reserve the right to cancel your Order and return the Products for sale on our Site. We will notify you of this decision 3 days before executing it and will refund the payment already made within 14 days from the date of cancellation of your Order (except in the case where we suspect fraudulent use of credit card

DELIVERY. 

We do not deliver to the following countries (the “Excluded Countries”): Afghanistan; Angola; Armenia; Azerbaijan; Democratic Republic of the Congo (formerly Zaire); Iran; Iraq; Kazakhstan; Kyrgyzstan; Kosovo; Lebanon; Liberia; Nigeria; North Korea ; Rwanda; Somalia; Sudan (North and South); Syria; Tajikistan; Turkmenistan; Uzbekistan; Yemen; as well as the countries of the former territories of the USSR and the Federal Republic of Yugoslavia and/or the Republic of Serbia. If you wish to receive your Products in one of these countries, we will our best efforts to arrange delivery and insurance at your expense prior to confirmation of your Order.

Deliveries in France are made by Chronopost, UPS, FedEx or Colissimo followed. Deliveries made outside France are made through Ferrari Logistique. We cannot be held responsible for a delay in delivery caused by an event beyond our control or if you are unable to provide us with adequate delivery information.

Delivery is complete when the Products arrive at the delivery address indicated or when you pick up your Products in one of our stores ( (Outside Switzerland) by yourself or your representative.

If you wish to use a transport company to collect your products from one of our stores (Outside Switzerland), the delivery will take place when the Products are delivered to this company in our stores (Outside Switzerland). We decline all responsibility in relation to the transport of the Products in this case.

The Products are your responsibility as soon as delivery has been made. 

You are the owner of the Products as soon as the total amount of your Order has been paid.

TARIFFS

 If you live outside France, you are likely to pay customs duties or other taxes in force in your country of residence in connection with the delivery of the Products. You must comply with the laws and regulations in force in the country of delivery. All amounts relating to the importation of the Products are your responsibility. We are unable to determine these amounts. If you are unsure of what amounts will need to be paid in relation to your Order, we recommend that you contact your local customs office for further information.

THE BEAUTIFUL WATCH WARRANTY 

We provide a  guarantee with our Products for a period of 12 months from the date of delivery. Except Waterproof

WATER RESISTANCE

 When ordering a wristwatch ("Watch"), you should be aware that a water resistant Watch does not mean that it is waterproof. For example, a Watch described as “water resistant up to 30 meters” (100 feet/3 bar) only withstands splashes. The Watches that we sell are allocated to the categories indicated in the glossary available on the Internet.

Water resistance or waterproofing is expressed either in meters or in bars (1 bar = 10 meters). This information is the result of a technical standard and does not reflect an exact depth. A watch “resistant to 10 meters” does not mean that it can be worn to such a depth but indicates that it is able to withstand a pressure equivalent to static immersion up to 10 meters. The movements of the wearer of the Watch (diving, jumping, swimming, etc.) as well as the force of water (shower jets, currents, waterfalls, etc.) can considerably increase the pressure applied to the Watch.

When your Watch is certified as “water resistant”, its water resistance is ensured by a set of seals. Before any contact with water, it is essential to check that the crown and pushers of your Watch are pushed in or screwed down, depending on the model. When your Watch is underwater, do not use the chronograph, minute repeater or 2nd time zone buttons and pushers. After swimming, rinse your Watch with clear water to avoid any corrosion due to salt water or chlorine. The seals of your Watch deteriorate over time. We therefore recommend subjecting your Watch to a water resistance test every year if you wear it during sports activities, or every two years in the event of normal use. Never try to open the case yourself. In the event of condensation under the ice, take the Watch to a certified repairer as soon as possible to avoid further damage.

DATE OF DOCUMENTS 

If a Product is sold with its Documents, the age of the Product is determined by the date indicated on the Documents. 

The date is the date on which the authorized retailer stamped the Documents. You understand that the date of manufacture/manufacture of the Products may be substantially earlier than the date indicated on the Documents. 

If a Product is sold without a Document, it may be difficult to assess the age of the Product, especially for older Products. You agree that the age mentioned in the Product description is given in good faith (calculated on the basis of the serial number, owner information or other information). As a result, the age of the Product indicated on our Website is only indicative. 

If a Product is sold without a Document, we make no warranty as to the age of the Product.

RETURN CONDITIONS

Purchases made in store can be exchanged without refund if returned within 14 days of purchase and have not been used. If no exchange is possible, a refund up to the purchase price will be allocated to you.

In case of returns, the client has 3 days from the day of the receipt to contact us, in order to arrange terms and procedures. 

Purchases made online can be returned or refunded within 14 days of receipt if the Product has not been used. Shipping and insurance costs are your responsibility in the case of a Product returned following a canceled sale. In this case, The Beautiful watch assumes no responsibility in the event of a return problem. You must return the Product to us or hand it over to us no later than 14 days from the date on which you inform us of the cancellation of your purchase.

Return costs, packaging and insurance are your responsibility and you must follow our instructions. We recommend using a delivery service that offers tracking and acknowledgment of receipt. You must insure the Product(s) for their full value and ensure that they are appropriately packaged to prevent damage in transit.

You must return the defective Products (together with the Documents, manuals and accessories) to us within 14 days of the date on which you inform us of the defectiveness of the Products.

If you are outside France, you may also have to pay customs fees and other taxes applicable in your country of residence. You are fully responsible for such duties and taxes. We are not responsible for the existence or the amount of customs duties and other taxes and we are not able to estimate the total amount that you will have to pay. Contact your local customs office for further information.

YOUR RIGHT OF WITHDRAWAL 

You can exercise your right of withdrawal on your Order within 14 days to receive a full refund. 

The right of withdrawal does not apply to Products purchased in one of our physical stores and/or if the Products have been modified following a special request from you.

You can exercise your right of withdrawal on your Order without justification. The withdrawal period expires 14 days after the day of delivery of the Products. 

If your Order includes several Products, the period begins to run from the day of delivery of the last Product. To cancel your Order, you must notify us by email (aftersales@thebeautifulwatch.com)

In the event of cancellation of your Order, you will be fully refunded. We may reduce the amount of the refund for loss of value in the event of unnecessary handling affecting the value of the Product. 

You must take reasonable care of the Products and return them to us (along with their Documents, manuals, service papers, boxes if applicable). The Products must be in their original state.

You understand that the Documents associated with a Product considerably increase the value of the Product and that their absence or damage considerably decrease the value of the Product. If you are unable to return the Documents to us or return them in poorer condition, we will deduct this loss in value from the amount of your refund,

Returned Products are inspected by our team. You will have to pay the cost of repair if our team finds that you have not returned the Products to us in their original condition or that they have been damaged or altered by use going beyond what is necessary to determine the nature, characteristics and operation of the Products.

The return costs are your responsibility. We will recommend the safest way to return the Products to us based on your location. You must insure the Products and pack them properly. In the event of return for cancellation of your Order, you assume the insurance and the packaging. The Beautiful watch assumes no responsibility in this circumstance.

You must return the Products to us or hand them over to us without delay but at the latest within 14 days of the date on which you notify us of the cancellation of your contract with us. The deadline is met if you return the Products before the expiry of the 14 days.

Subject to your compliance with this clause, we will proceed with the refund within 14 days from the date of receipt of the returned Products or from the date of receipt of the confirmation of the return of the Products. Reimbursement will be made by bank transfer to the bank account used during payment. No costs associated with the refund will be your responsibility.

As a consumer, you have rights. In particular, you can consult your rights with the authority or local consumer protection service in your country.

OUR RIGHT TO CANCELLATION 

We may have to cancel an Order before delivery of the Products, for example in the case of an event beyond our control or an unavailability in our stocks. We will contact you as soon as possible should this occur. If we have to cancel an Order and you have already made payment, we will refund this amount to you within 7 working days (except in case of doubt of fraudulent card use)

FRAUDULENT PAYMENTS

 We will not deliver any Product if we have sufficient reason to believe fraudulent payment or fraudulent use of a payment card. No refund will be made before validation by our bank.

CONFIDENTIALITY - RESPECT OF PRIVACY 

We attach great importance to the protection of your privacy. For this, we make every effort to minimize their collection, protect and secure your personal data, in accordance with the General Data Protection Regulation n°2016/679. Your personal information is only used within the framework of our Privacy Policy.

ENTIRE AGREEMENT 

The terms of these general conditions (together with the documents to which they refer) constitute the entire contract between us. They cancel and replace any previous agreement, written or oral, relating to our commercial relationship.

COMMUNICATIONS BETWEEN US 

If you would like to write to us, or if you are under a contractual obligation to write to us, please email us at aftersales@thebeautifulwatch.com If we need to contact you in writing, we will do so by prepaid post or email.

OUR RIGHT TO CHANGE THESE TERMS AND CONDITIONS

 We reserve the right to modify or revise our terms and conditions at any time. You are subject to the general conditions in force at the time you give your consent, except in the event of changes imposed by a modification of the legal framework or by a competent authority (with retroactive effect on your orders placed), or if we communicate a change to you. of our terms and conditions before you accept the sale (in which case you will be deemed to have read and accepted such changes).
